In compliance with the provisions of the Federal Law on the Protection of Personal Data Held by its Parties (Ley Federal de Protección de Datos Personales en Posesión de Particulares), including its regulations, guidelines, and other applicable secondary provisions in effect (the “Applicable Legislation”), Vitro Vidriera Monterrey, S.A. de C.V. with address at Ave. Ricardo Margain 400, Colonia Valle del Campestre, San Pedro Garza García, N.L., México (“Vitro”), and its affiliated, related and/or subsidiary companies (“Affiliates”), Vitro and its Affiliates collectively (“Vitro Group”), hereby inform you of this privacy notice (the “Privacy Notice”), and request that you read it carefully:
1. Definitions
Affiliates: Any affiliated, subsidiary and/or related company that forms part of Vitro Group, including those that, directly or indirectly, control, are controlled by, or are under common control with another entity, as well as those whose shareholders are, substantially, the same individuals or legal entities.
Personal Data: Any information relating to an identified or identifiable individual. An individual is considered identifiable when their identity can be determined, directly or indirectly, through any information.
Sensitive Personal Data: Personal data affecting the Data Subject’s most intimate sphere, or whose improper use may give rise to discrimination or entail a serious risk for such person. Sensitive Personal Data includes, but is not limited to, Personal Data that may reveal aspects such as racial or ethnic origin, present or future health status, genetic information, religious, philosophical or moral beliefs, political opinions, and sexual preference.
Personal Data Protection Department: The department of Vitro Group designated to receive, address, evaluate, manage, supervise and monitor data subjects ARCO Rights requests, as well as regulatory compliance.
ARCO Rights: The rights of access, rectification, cancellation and opposition to the processing of Personal Data.
Data Subject: The individual to whom the Personal Data belongs.
Transfer: Any communication of Personal Data, within or outside Mexican territory, made to a person other than the Data Subject, the data controller, or the party in charge of processing.
Consent: The free, specific and informed expression of will by the Data Subject, by means of which the processing of such data is carried out.
Vitro Form: The request required for the Data Subject to exercise their rights with respect to their Personal Data.
Portal: The Privacy Policy Portal of Vitro.
2. Personal Data Collected
As part of our registry of clients, suppliers, business partners, collaborators, financial institutions, debtors, creditors, as well as marketing and corporate communication activities, certain information that may be personally identifiable about you may be collected and processed. Such information may include, but is not limited to, the following:
A. Identification data: full name, address, email, cell phone and/ or work phone, marital status, signature, electronic signature, RFC, CURP, INE, place and date of birth, nationality, age, names of relatives, dependents and beneficiaries and medical information.
B. Professional data: occupation, position, area or department, address, telephone and work email, extracurricular activities, job references, personal references, academic history, performance history in the company, among others.
C. Assets data: bonuses, wage withholdings, movable and immovable property, credit history, income and expenses, bank accounts, insurance, AFORES, sureties, contracted services, personal references, among others.
We undertake to process Personal Data in accordance with Applicable Law, under strict security measures, always guaranteeing its confidentiality.
For the purposes indicated in this Privacy Notice, we may collect your Personal Data in various ways:
(a) When you provide it directly;
(b) When you visit our website;
(c) When you use our online services, and/or;
(d) When we obtain information through other sources permitted by the Applicable Legislation.
3. Purpose of Data Processing
Your Personal Data may be used for the following purposes related to our business relationship:
(a) Marketing the products and services offered by Vitro Group.
(b) Processing and administration of returns, billing, customer purchase history, payments, discounts, notifications of promotions, pre-sales, access to the customer and supplier portal.
(c) Monitor any phone calls made with you.
(d) Update the registers and systems programs of Vitro Group.
(e) Use them in cases of mergers, divisions or acquisitions of Vitro Group.
(f) Comply with the requirements made by authorities, when necessary to safeguard the public interest, the procurement or administration of justice.
(g) Where appropriate, prepare and carry out contracts for the sale, consignment, distribution, supply of products or services, among others, according to the case of what the client requires.
(h) Compliance with obligations arising from the legal relationship established with the client.
(i) Provide the services and products required by the client in a timely and proper manner.
(j) Make inquiries, investigations and reviews regarding your complaints or claims.
(k) Contact you for any matter related to Vitro Group products and services or this Privacy Notice.
If you do not wish Vitro Group to process your information for advertising, promotional, corporate communication and market research purposes, you may revoke your consent by contacting the Personal Data Protection Department at the following email address: proteccióndedatos@vitro.com. We hereby inform you that Vitro Group will not collect or process your Sensitive Data. In the event that Sensitive Data is collected and processed, Vitro Group shall obtain your express consent.
4. Transfer and Transmission of Data.
Your Personal Data will never be disclosed to or shared with third parties (there will be no data transfer), nor will it be used for any purpose other than that set forth in Section 2 above, unless there is a change to this Privacy Notice.
Nevertheless, we reserve the right to engage a third party for the administration and management of this Portal, as well as to understand its use by visitors. Even though this third party may collect information about you on our behalf, we control the use of such information in accordance with this Privacy Notice.
In cases where Personal Data is processed by affiliates, subsidiaries, service providers, or business partners located outside Mexico, such entities shall comply with the Personal Data protection legislation applicable in their respective jurisdictions, including, where relevant, the European Union General Data Protection Regulation (GDPR). Compliance with such laws shall not modify, diminish, or otherwise affect the obligations of the applicable Vitro Group entity acting as the data controller under the data protection laws governing its processing activities.
We do not market, sell or rent your personal information to third parties.
The warning is made so that Vitro Group can use “cookies” to confirm your identification, personalize your access to this Portal and review its use, with simply the purpose of improving your browsing and its conditions of functionality, since the aforementioned “cookies” do not collect personal data from users in terms of the Law. This Portal has links to other external sites, of which the content and policies privacy statements are not the responsibility of Vitro Group.
Any additional transfer of your Personal Data requiring your consent will be communicated to you in advance, through the communication and update of this Privacy Notice, and prior to such data transfer taking place.
5. Exercise of ARCO rights
The users of the Vitro Portal and/or its subsidiaries have recognized and may exercise the ARCO Rights (Access, Rectification, Cancellation and Opposition), by directly sending their request to the person responsible through the following email account: proteccióndedatos@vitro.com
Such request must contain:
- Your full name;
- Address or other means by which to communicate the response to your request;
- Documents evidencing identity, or, where applicable, legal representation;
- A clear and precise description of the Personal Data with respect to which any of the ARCO Rights is sought to be exercised; and
- Any other element that facilitates locating the Personal Data.
The Data Subject understands that, should any of the information requested in Vitro Form be omitted, their request will not be admissible.
6. Revocation of the Consent and limitation of use or disclosure
At any time, you may revoke the consent you have given us for the processing of your Personal Data, in order to suspend its use or disclosure. This applies in all cases where such revocation does not render it impossible to comply with obligations arising from an existing legal relationship between you and Vitro Group.
Likewise, you may limit the use or disclosure of your Personal Data. To do so, you must fully complete Vitro Form and send it to the following email address: proteccióndedatos@vitro.com.
7. Changes to the Privacy Policy
In the event of any change to this Privacy Notice, Portal users will be notified as follows: (a) by sending an email to the account you have registered on this Portal, and/or (b) by publishing a visible note on our Portal.
We will not be held responsible if you do not receive notice of a change to the Privacy Notice due to a problem with your email account, data transmission over the internet, or if you were unable to access the Portal for any reason not attributable to Vitro Group.
For your safety, we recommend that you periodically review the Portal to stay informed of any updates to our Privacy Notice. We reserve the right to change this Privacy Notice at any time. The laws and regulations of different countries may impose different (and even conflicting) requirements regarding the internet and the protection of information. We are located in Mexico, and all matters relating to this Portal are governed by the Applicable Legislation. If you are located in another country or outside of Mexico and contact us, please take into account that any information you provide will be transferred to Mexico, and by entering your information, you authorize this transfer and accept the conditions set forth in this Privacy Notice.
